This is not what you want to hear, from such a cruising destination as Phuket, but frankly there has long been reports of petty crime and theft from boats left in Chalong Bay, for the most part on unattended yachts. They are an obvious target.

In this case, the thieves thought they had the yacht to themselves to gather their stolen loot and ransack the yacht, but they were disturbed by a brave captain.

Recent armed attacks against yachties by thieves in popular Chalong Bay in Phuket, Thailand, is the first violence that the local cruising community can remember here towards yachts in a very long time. A French yachtsman suffered severe knife wounds during an attack aboard his boat last week, and in another incident shots were fired when thieves were surprised during an attempted burglary on a vacant boat.

It is tragic for cruising sailors when once safe anchoring spots become dangerous and one can only hope that this is an isolated case.   Witnesses reported at least two shots fired in the dark on Chalong Bay last week as a gang of thieves gave chase to a Phuket boat captain who outfoxed the criminals until the police arrived in force.

Capt Bruce Issell was the hero of the incident.  He was warned by a silent alarm at about 11:30pm that intruders had boarded the Davinci, catamaran.

He raced to Chalong Pier, boarded the Davinci’s dinghy and headed for another vessel, a Sunseeker 50, to investigate what had triggered the alarm.

Once aboard the Sunseeker, he motored to the Davinci catamaran with spotlights ablaze at full strength. ‘The thieves found themselves well and truly lit up, but could see only one person aboard the Sunseeker,’ a witness told Chris Husted, News Manager with the Phuket Gazette.

Seeing only one boat approaching them, the thieves attacked the Sunseeker and attempted to board the luxury yacht and capture Capt Issell and his one young Thai crewman. A chase ensued throughout the moored yachts and commercial craft in the bay for some 20 minutes, with the Sunseeker ducking and weaving to hold off the raiders.

‘There were at least two bright flashes as the thieves fired shots at the Sunseeker. You could see the flashes from the shore,’ the witness told the Gazette.

Police reinforcements quickly arrived in dinghies, changing the balance of power. The thieves soon surrendered and were escorted to the floating marina under construction in the bay. ‘They were questioned and handcuffed, and the stolen items were inspected,’ the witness told the Gazette. ‘For all their efforts, the thieves had managed to steal only some children’s foam paddle boards, a set of binoculars, some flashlights and other odds and ends,’ the witness confirmed.

Scuffles broke out as the officers placed the gang of about four men under arrest. The men were then transported to Chalong Police Station in the back of a police pickup truck.

The bright yellow dinghy the thieves had used in the thwarted raid was also seized as evidence.

The catamaran was taken from its mooring to the marina for further police inspection.

‘I could not be less than 100% impressed with all concerned – Bruce Issell and his crewman – and the very professional Chalong Police,’ said the witness, who asked not to be identified publicly.

Niwat Duangmanee and Theeraphol Malasan, both 21, were later charged with using knives to commit armed robbery, using a vehicle to evade police and receiving stolen property after a cat-and-mouse chase through Chalong Bay marina that ended with police firing into the air and apprehending the men.
It is hoped that the men arrested were the same raiders who have terrorized the Baan Nit area off Cape Panwa in the previous week. A Frenchman whose yacht was anchored in that area was startled by raiders late one night. A scuffle broke out on board and the Frenchman suffered at least seven knife lacerations during the attack, including a cut to his head. Fearing for his safety, the Frenchman did not return to sleep on his yacht that night. It may have proved a prudent move as the thieves returned the same evening and made off with what was reported as a substantial bounty of yachting ‘removables’.
The yacht has now sailed away, no doubt with no intention to return.

The government department responsible for shipping and vessel safety needs an urgent overhaul, investigation of collision concludes

“Serious systemic failings” in the Marine Department contributed to the Lamma ferry tragedy, the Commission of Inquiry into the disaster has found.

In its report, released yesterday, the commission pointed to a “litany of errors” at every stage of the design, construction and inspection of the Lamma IV, which contributed to the rapid sinking of the boat.

“What is required is systemic change, in particular a change in attitude to responsibility and transparency,” the commission said of the department. “In [some] areas, what is required is action, and action now.”

The commission, led by Mr Justice Michael Lunn, said it was “astonished and deeply dismayed” to learn that the department had not fully enforced a 2008 regulation stipulating that vessels should carry a number of lifejackets matching their capacity, as well as children’s lifejackets equal to five per cent of capacity.

The key factors so many lives were lost were loosely attached seats on the upper deck of the Lamma IV that came off, throwing passengers towards the stern; passengers having trouble getting to and donning lifejackets; and no children’s lifejackets.

The department has promised an internal investigation into whether any officer bears part of the responsibility for Hong Kong’s deadliest sea tragedy in 40 years.

A total of 39 passengers died when the Hongkong Electric vessel Lamma IV, taking workers and their families to see the National Day fireworks in Victoria Harbour, collided with the ferry Sea Smooth off Lamma Island.

Sections of the report dealing with the responsibilities of the two coxswains involved in the October 1 crash – both of whom have been charged with manslaughter – was redacted to avoid influencing their trials.

Secretary for Transport and Housing Professor Anthony Cheung Bing-leung said he would lead a steering committee to oversee the reform of the department. He said he would appoint a directorate-grade officer as deputy director of the department to lead the reforms.

Director of Marine Francis Liu Hon-por said the department had appointed foreign experts to review its inspection procedures and compare safety regulations with those in Singapore, Sydney and Southampton.

Chief Executive Leung Chun-ying pledged that the government would handle any case of maladministration or human error impartially, and said disciplinary hearings could start.

Liu did not answer if he would apologise or resign. Cheung said he “felt sorry”.

Ryan Tsui Chi-shing, younger brother of Tsui Chi-wai and uncle of Tsui Hoi-ying, 10, who both died in the crash, said he appreciated that the inquiry had shed light on a lot of facts. But he had doubts whether the reforms would succeed: “The director lacks the courage to even apologise, so how can I trust him to have a conscience in future?”

This development is entirely separate to the Accident Investigation that took place earlier and which is expected to publish its report on the matter by the end of April.

The scope of that investigation was to establish the events that took place and make recommendations for actions that could assist to prevent accidents of a similar nature, and to recommend amendments to regulations based on the findings.

This latest development with Manslaughter charges to both skippers comes from the Police Investigation. They have levelled a different charge to each skipper. Perhaps surprisingly only the skippers have been charged and not any of the Officers. As Yet.

Given the tragic loss of life (almost one third of passengers perished) and avoidable nature of the accident, charges were inevitable.

The captains of two vessels that collided off Lamma Island on October 1 made their first appearance in court yesterday, facing a combined 78 counts of manslaughter.

Chow Chi-wai, 56, captain of Hongkong Electric’s Lamma IV, and Lai Sai-ming, 55, captain of the Sea Smooth, operated by Hong Kong and Kowloon Ferry, are each charged with 39 counts of manslaughter.

Chow and Lai were represented by Gerard McCoy SC and Audrey Campbell-Moffat, respectively, in Eastern Court.

The pair are accused of unlawfully killing 39 people by gross negligence. The victims died on October 1, 2 and 5.

Some died at the scene and some in hospital.

Court documents say Chow owed a duty of care to his passengers and Lai to other vessels and their passengers. They were allegedly in breach of that duty of care by failing to keep a proper lookout, and to take any effective measures or steps to avoid the collision.

The gross negligence caused by the breach of duty was allegedly a substantial cause of the death of the victims.

Principal Magistrate Bina Chainrai adjourned the case to May 9 upon the request of Director of Public Prosecutions Kevin Zervos. Zervos said the prosecution needed four weeks to prepare documents, and on the next occasion it would ask for a return-day hearing.

Chow and Lai were released on HK$20,000 cash bail each. The court also ordered them to surrender all their travel documents.

Four fired for marooning minesweeper on ocean reef

The Navy fired the former commanding officer of the now-stricken mine countermeasures ship Guardian along with three of his officers after an investigation determined they “did not adhere to standard U.S. Navy navigation procedures,” the Navy said Wednesday.

Lt. Cmdr. Mark Rice, the ship’s CO, was fired Wednesday by Rear Adm. Jeffrey Harley, the commander of Expeditionary Strike Group 7. The reliefs came while Rice and his crew were to take charge of the replacement ship, the minesweeper Warrior, which arrived last week in Sasebo, Japan.

The reliefs included the second-in-command, Lt. Daniel Tyler, who also served as the navigator; the assistant navigator; and the officer standing watch as the officer of the deck at the time of the grounding. Officials declined to release the names of the other reprimanded junior officers, citing privacy laws.

“All four sailors were relieved by Rear Adm. Jeffrey Harley due to their role in the grounding and a loss of confidence,” the Navy’s press release said.

They have been temporarily assigned to ESG-7 pending the completion of the investigation.

The reliefs complicate the picture of the Jan. 17 grounding in the Philippines, which officials have so far blamed on an error on a digital chart that incorrectly plotted the Tubbataha Reef eight nautical miles from its actual location. Guardian ran hard aground and the crew of 79 was removed without injury. But the months-long saga, as Guardian’s fiberglass and wood hull pounded furiously against the coral while experts attempted to extricate it, was covered for weeks in the press and angered locals because the damage occurred in a National Marine Park, which has been designated a World Heritage Site by the United Nations.

The 7th Fleet commander, Vice Adm. Scott Swift, apologized four days after the incident.

The minesweeper was decommissioned on March 6 in Sasebo, Japan. Navy divers finished sawing through the hull and craning the cut-apart hull off the reef on March 29.

It appears that with the removal of the Stern Section of the USS Guardian, that all major parts have been lifted from the Tubbataha Reefs.

All involved seem to have done a first class job to achieve the target of removing the minesweeper by the end of March. No doubt there will be seabed surveys and the clearance of small fallen debris that will need to be done, but that work should soon be completed.

All in all we should be happy that the reef has been returned to some sort of quiet normality within less than three months of the grounding.

Now we just have to wait for 250 years for the Reef to fully recover !

Here’s are some photo updates from what’s now left of the USS Guardian at Tubbataha Reefs. The Salvage crews have been making good progress with the chainsaw’s.

To date they have removed all of the ship superstructure the bridge deck and most of the main deck level !

The USS Guardian Bridge Deck, where the on watch crew set the fateful course for the vessel that led her to founder on the Tubbataha Reef is now seen on the deck of the Crane Vessel, the Jascon 25.

It’s from one of those consoles that the on watch crew declined to heed the radio warnings from the Park Rangers, that the ship had entered the restricted reef area, and famously reportedly radioed back to “bring [their] complaint to the U.S. Embassy.”  A sad tale and a sad outcome for the USS Guardian.

Whilst the ship was being cut up, the US Navy held a USS Guardian Valedictory at the ship base in Japan. The following are extracts from the ceremony.

Vice Adm. Tom Copeman , Commander Naval Surface Force, U.S. Pacific Fleet fittingly remembers USS Guardian, now being scrapped.

“During times of war and while operating in international exercises for nearly a quarter of a century, the crew and ship remained at the highest levels of readiness, serving our nation well,” noted Admiral Copeman. He continued:

“A significant moment during a ship commissioning ceremony occurs when there is a call to ‘bring this ship to life,’ and the crew sprints from their positions pierside, across the brow and into the ship itself, effectively adding life to what was once cold iron.

Equally momentous for a ship is when she is decommissioned, stricken from the fleet and returned to cold iron; the crew and former crewmembers left with their memories and reminders of serving our nation and multiple missions on an endless sea.

Well in this case it is wet wood not cold iron as she is a minesweeper, but we get the point.

The Salvage crew have made good progress and they will be keen to complete the job as quickly as posible before bad weather like this sweeps in again.

With the superstructure and bridge deck gone the ship structure will be weak and any large swell and waves like above could break up the vessel hull and scatter the contents around the reef. I’m sure they will be “buzzing” to get things completed, and get the job done.
